Read MorePrince Harry has been quite outspoken recently, but could what he revealed in his memoir, Spare, and in subsequent interviews to promote the book, be a problem for Harry? In the confessional book, which was released in January, Harry revealed that he drank heavily, used cocaine, and smoked marijuana throughout his life, Page Six reported. Harry says he only used cocaine as a teenager, but he recently told trauma expert Gabor Maté in an online chat to promote "Spare" that he experimented with psychedelics as an adult and that hallucinogenic drugs were a "fundamental" part of his life He stated that he considers them a "fundamental" part of his life.
"It was cleaning the windshield, getting rid of the filters (layers of these filters) in my life. It wasn't until I started doing it recreationally that I started to realize how good it was for me."
According to former federal prosecutor Neama Rahmani, "admitting drug use is usually grounds for inadmissibility" under Harry's U.S. visa status, which allows him to stay in the United States. This means that since Prince Harry has admitted to using cocaine, mushrooms, and other drugs, his visa should have been denied or revoked." Rahmani adds that "there is no exception for royalty or recreational use."
All points are refuted, and attorney James Leonard, who represented Joe Giudice of The Real Housewives of New Jersey in his immigration lawsuit, says there is no high risk that Harry's visa will be overturned.
"Unless there are drug or alcohol-related criminal charges or a judicial finding that Prince Harry is a habitual drug user, which is obviously not the case, I see nothing wrong with the disclosures in his memoirs about recreational drug experimentation," he says.
Leonard explains that drug users who are not U.S. citizens must give immigration authorities a reason to initiate an investigation, such as criminal activity.
"You have to give them something to trigger that, and you have to reveal something in your book like you experimented with drugs when you were younger," he says.
"Immigration is not going to do anything based on that. If he gets arrested or arrested for DUI, that's a different story."Immigration attorney Sam Adair agrees with Leonard, "It is unlikely that such an entry permit would be a problem. If he had a criminal record, it would have been a major problem in obtaining a visa. That is not to say that drug use would not be an issue in immigration proceedings, but it is unlikely to be an issue in this situation. However, recreational drug use that is not the subject of a criminal investigation is unlikely to be a problem for someone's visa status."
Rahmani argues that "there is no requirement that you have actually been convicted of a drug offense," adding that there is a loophole that allows drug users to stay in the U.S. if they can obtain a waiver proving that their substance abuse is in remission. If you stay sober for a year, you are considered to be in remission," Rahmani says.
[19] "An application for a waiver requires medical records from a doctor, but since immigration files are not publicly available, it is not known if Prince Harry has filed such an application."According to Adare, past recreational drug use "is not something that would be addressed in a visa interview," so it likely would not have been an issue in Harry's approval process. He says, "If there was an arrest, indictment, or conviction, drug use could be an issue, but recreational drug use would not be something that would be brought up in a visa interview."
Page Six quotes a 2021 article in The Times, which states that Harry has no plans to seek permanent residency, citizenship, or a "green card" in the United States.
