Kristin Cavallari accuses Jay Cutler of "marital misconduct" in court documents.

Kristin Cavallari and Jay Cutler announced their divorce yesterday after 10 years together. Shortly thereafter, rumors surfaced that Cutler had an affair with Cavallari. And while a source told People yesterday that the affair was not the cause of the couple's divorce (open in new tab), Cavallari accused Cutler of "marital misconduct" in court papers filed.

Entertainment Tonight (opens in new tab) has reviewed the documents. According to the magazine, Cavallari's attorney filed the papers in Tennessee on April 24, claiming that Cutler has engaged in "improper marital conduct that makes further cohabitation dangerous and inappropriate." She added that "the misconduct alleged or implied against her in the divorce complaint is in response to and/or a result of her husband's misconduct."

Marital misconduct is a legal term used in Tennessee to describe a variety of situations (open in new tab). Adultery, domestic violence, verbal abuse, emotional and physical abuse (or threat of abuse) all fall under the umbrella of "marital misconduct" claims. The Cavallari papers do not specify what behavior Cutler allegedly exhibited.

It was Cutler who first filed for divorce; according to ET, he cited "irreconcilable differences" and gave the date of separation as April 21, the same day the papers were filed.

Cavallari listed April 7 as the date of separation in his papers.

The magazine noted that a temporary restraining order was filed, as is standard in Tennessee divorce cases. That order "prevents Cutler and Cavallari from disposing of or concealing the couple's property, harassing each other, or transferring the children from one school to another," the magazine wrote.

"People" heard yesterday from a source that the couple's breakup was due to their incompatibility and had "nothing to do" with Kelly Henderson (Cavallari's longtime best friend with whom Cutler was rumored to have cheated) or the cheating rumor. 'Christine and Jay are quite different. She is full of her brand and her show ("Very Cavallari"). Jay is not really interested in those things. She is very passionate about her work, and they didn't really share much. So they drifted apart."

Cavallari kept his public statement friendly, writing:

With great sadness, we have come to the loving conclusion that after 10 years together, we are divorcing. We have nothing but love and respect for each other and are deeply grateful for the years we shared, the memories we made, and the children we are so proud of. This is just a situation of two people growing apart. We ask that you respect our privacy as we work through this difficult time in our family.
